Reasons/basis
The facts of the case
Mr Thomas was a director of Richardson Lissack Limited, the recognised body for the purposes of providing legal services, as a barrister in 2023. Mr Thomas is still employed in this role.
On 7 February 2023 Mr Thomas wrote a letter on behalf of a client which contained content which did not uphold public trust and confidence in the solicitors' profession and in legal services provided by authorised persons.
Decision on outcome
It was decided that a rebuke was an appropriate and proportionate sanction.
Mr Thomas was issued with a written rebuke and ordered to pay costs of £1,350.
A more serious sanction was not considered to be proportionate by reference to the following factors in the Enforcement Strategy:
- there was no lasting significant harm to consumers or third parties
- there is low risk of repetition and
- some public sanction was required to uphold public confidence in the delivery of legal services
